These Terms of Service ("Terms") govern your use of Daily Summa, a subscription service operated by Daily Summa LLC ("Daily Summa," "we," "us," or "our"). By enrolling in or using Daily Summa, you agree to these Terms. If you do not agree, do not use the service.
These Terms apply to all users of Daily Summa, including parents, guardians, and any other individuals who enroll on behalf of a family.
The Service
Daily Summa is a subscription service that delivers automated daily homework and assignment digest messages to families via email and SMS. The service connects to your school's Canvas Learning Management System (LMS) using a read-only API access token you provide, and generates digest messages based on the academic data retrieved.
Daily Summa currently supports Canvas LMS. Support for additional learning management systems may be added in the future.
Daily Summa is an independent service and is not affiliated with or endorsed by Canvas, Instructure, or any school or school district.
Eligibility
You must be at least 18 years of age to enroll in Daily Summa. By enrolling, you represent that you are the parent or legal guardian of the student(s) for whom you are enrolling, and that you have the legal right to authorize access to their academic information through the Canvas API token you provide.
Daily Summa is not intended for use by students acting on their own behalf without parental enrollment.
Subscription and Billing
3.1 Subscription Plans
Daily Summa is offered as a monthly subscription. Current pricing is displayed at dailysumma.com. Prices are subject to change with 30 days notice to active subscribers.
3.2 Free Trial
Daily Summa may offer a free trial period for new subscribers. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
3.3 Billing
Subscription fees are billed monthly in advance. Payment is processed by Stripe. By providing payment information, you authorize Daily Summa to charge your payment method on a recurring monthly basis until you cancel.
3.4 Cancellation
You may cancel your subscription at any time by emailing privacy@dailysumma.com with your family name and the subject line "Cancel My Account." Cancellation takes effect at the end of your current billing period. You will continue to receive service through the end of the period for which you have paid. We do not provide prorated refunds for partial months.
3.5 Failed Payments
If a payment fails, we will attempt to notify you by email. If payment is not resolved within 7 days, your subscription may be suspended until payment is updated.
Your Responsibilities
4.1 Canvas API Token
Daily Summa requires a valid Canvas API access token to function. You are responsible for:
- Generating a Canvas API token with no expiration date as instructed during enrollment
- Keeping your token active and renewing it if it expires or is revoked
- Notifying us promptly if your token changes by submitting an update via dailysumma.com
Daily Summa is not responsible for service interruptions caused by an expired, revoked, or invalid Canvas API token. Token expiration is the most common cause of missed digests.
4.2 Accurate Information
You are responsible for providing accurate enrollment information including your correct email address, student name, school Canvas URL, and notification preferences. Inaccurate information may result in failed or misdirected digest messages.
4.3 Account Security
You are responsible for maintaining the security of your Canvas API token. Do not share your token with anyone other than Daily Summa. If you believe your token has been compromised, revoke it immediately from your Canvas account settings and generate a new one.
Service Availability and LMS Dependency
Daily Summa depends on the availability of your school's Canvas LMS instance and the Canvas API. We do not guarantee uninterrupted service and are not responsible for service disruptions caused by:
- Canvas LMS downtime, maintenance, or API outages
- Your school's restriction or modification of Canvas API access
- Changes to Canvas API functionality by Instructure
- Expired or revoked Canvas API tokens
- Internet or infrastructure outages outside our control
We will make reasonable efforts to notify you of known service disruptions that affect your daily digests. Scheduled or unscheduled Canvas maintenance is outside our control and will not result in service credits or refunds.
Intellectual Property
Daily Summa and its original content, features, and functionality are owned by Daily Summa LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Daily Summa service without our express written permission.
The digest messages we generate and deliver to you are for your personal, family use only. They may not be resold, redistributed, or used for commercial purposes.
Disclaimer of Warranties
Daily Summa is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- The service will be uninterrupted, error-free, or available at all times
- Digest messages will be complete, accurate, or delivered on time in all circumstances
- The service will meet your specific expectations or requirements
Academic data displayed in your digests reflects what is available through the Canvas API at the time of each run. We are not responsible for discrepancies between Canvas API data and data displayed in your school's web interface.
Limitation of Liability
To the fullest extent permitted by applicable law, Daily Summa LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to:
- Missed assignments or academic consequences resulting from delayed, failed, or inaccurate digest messages
- Unauthorized access to your Canvas account or academic data
- Service interruptions caused by Canvas LMS or third-party provider outages
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to Daily Summa in the 30 days preceding the claim.
Acceptable Use
You agree not to use Daily Summa to:
- Access academic data for any student for whom you are not the legal parent or guardian
- Attempt to reverse-engineer, scrape, or extract data from our service beyond your own family's digests
- Use the service in any way that violates applicable law, including FERPA or COPPA
- Resell or redistribute access to the service
Violation of these acceptable use terms may result in immediate termination of your subscription without refund.
Termination
We reserve the right to suspend or terminate your subscription at our discretion if you violate these Terms, provide false enrollment information, or use the service in a manner that harms other users or the integrity of the service.
You may terminate your subscription at any time as described in Section 3.4. Upon termination, your data will be deleted as described in our Privacy Policy.
Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this document and notify active subscribers by email at least 14 days before material changes take effect.
Continued use of Daily Summa after the effective date of revised Terms constitutes acceptance of the updated terms.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Hillsborough County, Florida.
